Halistawi Terms and Conditions

1. Introduction

Welcome to Halistawi! These Terms and Conditions ("Terms") govern your access to and use of the Halistawi mobile health application (“App”), website, and related services (collectively, the "Services"). These Terms constitute a legally binding agreement between you and Halistawi. By accessing, registering for, or using our Services, viewing our content, you agree to comply with and be bound by these Terms. If you do not agree, you must not use our Services.

2. Definitions

For the purposes of these Terms:

  • "User" refers to any individual who accesses or uses the Services, including account holders and those managing dependent accounts
  • "Dependent" refers to your child under 18 years old whose account is managed by a parent or legal guardian.
  • "Subscription" refers to the paid plans available to access the full features of the Services after any applicable free trial period.
  • "Data" includes any information you input into the App, such as medications, appointment details, blood pressure (BP), blood sugar levels, or other account related information.

3. Eligibility

  • 1. You must be 18 years or older to open an account.
  • 2. If you are managing a dependent account, you confirm that you are the parent or legal guardian of the dependent.
  • 3. By using the Services, you represent and warrant that you meet the eligibility requirements and are legally permitted to enter into this agreement.

4. Services Overview

Halistawi provides the following features and functionalities:

  • Personal Management Tools: Set reminders for medications and appointments, and monitors status of BP and blood sugar test results, and issues alerts for “bad” test results.
  • Data Organization: Store, organize, and access data records.
  • Reporting: Generate, download, and share data reports via WhatsApp or SMS.
  • Dependent Management: Create and manage accounts for your dependents with the same tracking and reporting features.

5. Account Creation and Management

  • 1. Account Registration: You must provide accurate and complete information during registration and update it as necessary to keep it current.
  • 2. Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • 3. Dependent Accounts: Users managing dependents must ensure that their dependent’s data is accurate and used responsibly.

6. Privacy and Data Security

  • 1. Data Ownership: All Data entered into the App or Halistawi platform belongs to you, the User.
  • 2. Data Usage: Halistawi uses your data only to provide, improve, and personalize the Services.
  • 3. Data Sharing: You may share data with others at your discretion. Halistawi is not responsible for the security of data once shared externally.
  • 4. Data Retention: Halistawi retains your data for the duration of your use of the Services and may retain data for research, analytics or as required by law after account closure.

7. Subscription Plans and Payments

  • 1. Free Trial: Eligible users may access a 7-day free trial, during which all features are available.
  • 2. Subscription Plans: After the trial, continued access requires a paid subscription. Available plans include:
    • Monthly Plan: 1,500 [Insert Currency] per month.
    • 3-Months Plan: 10% discount if paid upfront.
    • 6-Months Plan: 20% discount if paid upfront.
  • 3. Payment Methods: Payments can be made through in-app payment gateways or USSD options.
  • 4. Renewals and Cancellations:
    • Subscriptions are manually renewed.
    • To avoid service interruption, subscriptions should be paid before renewal date.
    • Once paid, you cannot cancel your subscription.
    • Subscription refunds are not available.
  • 5. Activation of Features: Reminders, alerts, new data recording, and new reporting are only activated when subscriptions are active.

8. Acceptable Use Policy

By using the Services, you agree not to:

  • 1. Use the App for any illegal, fraudulent, or unauthorized purpose.
  • 2. Upload or input false, misleading, or harmful data.
  • 3. Interfere with the functionality or performance of the App.
  • 4. Attempt to access or hack other Users’ accounts or data.
  • 5. Share your account credentials with unauthorized persons.

Halistawi reserves the right to investigate and take legal action against any misuse of the Services.

9. Limitation of Liability

  • 1. Halistawi is not liable for any damages resulting from:
    • Inaccurate or incomplete data entered by the User.
    • Technical issues or interruptions in Service availability.
    • Unauthorized access to or use of your account.
    • Reliance on reminders or alerts provided by the App.
    • Failure for you to follow your healthcare providers and doctors instructions.
  • 2. The Services are provided "as-is" without warranties of any kind, either express or implied.

10. Intellectual Property

  • 1. All content and materials within the App, including text, graphics, logos, and software, are the property of Halistawi or its licensors.
  • 2. You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes.
  • 3. You may not reproduce, distribute, or modify any part of the App without explicit written permission.

11. Updates and Modifications

  • 1. Halistawi reserves the right to update or modify these Terms at any time.
  • 2. Updates will be communicated through the App, USSD SMS or Phone. Continued use of the Services after such updates constitutes acceptance of the revised Terms.

12. Termination of Service

  • 1. Halistawi may suspend or terminate your account for violations of these Terms or applicable laws.
  • 2. Upon termination: You will lose access to the reminders, alerts and new data storage in the App or USSD,

You may opt to terminate your account at any time however the data remains in use by Halistawi for purposes including but not limited to research and legal.
